Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impalement hazards: a)Site at 4370 West Main, Dothan, Al: While painting the stairway landing platform on a flat roof an employee was working within 12 - 16 inches of a lightning rod that has a pointed tip. This exposed the employee to impalement hazards as he worked near and around the lightning rod while painting the underneath and outer portion of the stairway landing platform. Feasible means of abatement would be to install protection caps on the exposed end or have the rod temporarily removed.
