Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about February 15, 2008, at a jobsite located at 4187-89 S. Halsted Street, Chicago, Illinois, - an employee was exposed to struck-by and caught in between hazards, when working in the area of the Caterpillar Excavator where the swing radius was not provided with a method to prevent employees from entering. The employee was working and walking in close proximity picking up debris while the excavator was being operated. The employee was observed in numerous areas that could have result in him being hit or run over by the excavator, because he was not in view of the employee on the ground. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as: Comply with the Association of the Equipment Manufactures (AEM) for Hydraulic Excavators which states: Set up safety barriers to the sides and rear area of your swing pattern to prevent anyone from walking into the working area, never enter or allow anyone else to enter the excavator swing pivot area. Death or serious injury can result. Never lift, move or swing a load over anyone or the cab of a truck or other machine. Comply with the manufactures Operation and Maintenance Manual which states. Make sure that no personnel are on the machine or near the machine in order to prevent any personal injury. Keep the machine under control at all times in order to prevent injury.
