Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee were exposed to fall hazards and other serious hazards from the operator leaving the position to control the rough terrain forklift truck: a. On or about June 14, 2008, at a jobsite located at 3348 W. Douglas Blvd, Chicago, Illinois - an employee performing masonry work from a work platform that was secured to the forks of a Pettibone rough terrain forklift was exposed to fall hazards in that the operator was not present to operate the controls and/or the platform was not equipped with controls. Among other methods, one feasible and acceptable abatement method would be to comply with the ASME/ANSI B56.6-2002 for all rough terrain forklift trucks. Also, an operator should be stationed at the control panel and remain in position of controls at all times.ls
