Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a.  On or about August 7, 2008, at the above addressed jobsite, employees
were using a Hitachi
Zaxis 200 LC hydraulic excavator with a chain installed around the
excavator arm attached to
a wrecking ball.  The employees were thereby exposed to struck by hazards
created by an
improperly secured load (wrecking ball).  One feasible and acceptable
method of abatement,
among others, to correct the hazard would be to comply with the operators
manual which states
"Never move a load quickly...Fasten sling/chain to bucket loop, with the
bucket curled and arm
retracted"  In addition, the Equipment Manufactures Institute, safety
manual for operators and
mechanics hydraulic excavator states "Attach chains and slings to the
manufacturer's designated
lifting points on the excavator bucket."r
