Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from the boom of a crane: a) Ventnor City Pier, South Cambridge Avenue and the boardwalk, Ventnor, New Jersey: The employer was using the boom of a crane to raise and lower dock builders from the beach to the deck of the pier being dismantled, a height of approximately fifteen feet. On or about 12/5/07. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
