North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina: The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to caught between and/or struck by hazards:
a)establishment, loading/unloading dock, Mitsubishi Type G
powered industrial fork lift - the fork lift was not
equipped with seat belts and the operator was exposed to
the hazard of falling out of the fork lift during a drive
off or tipover and caught between the overhead roll over
protective system and the pavement or ground.
Among other methods, one feasible and acceptable
abatement method would be to install the seat belt retro
fit kit provided by Mitsubishi and to require its use to
keep the operator inside the truck in the event of a
tipover.
