Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a)Tripping hazards causing multiples fractures, severes contusions,
lacerations,
abrasions and death in case of a free falling nearly at 80 feet high above
the floor.
Employees were working daily and continually in different tasks such as
maintenance, electrical works, mechanical works, and walked over a concrete
step of 6'6" large x 1'1" width located at the entrance of the manlift
area which
at the same time did not have guardrails or any type of self closing gate
in the
front side of the manlift that avoid employees could have an empty space
falling
nearly of 80 feets above the floor.
Location:  At the workplace known as "Federacion de Asociaciones Pecuarias
de
PR" last floor, at the entrance of the manlift area.
Among other methods, one feasible and acceptable method to correct this
hazard
is the elimination of the concrete step in this area and put guardrails or
a self
closing gate at the front of the manlift, to avoid a free falling hazard.
a)Riesgos de tropiezos ocasionando multiples fracturas, contusiones
severas,
laceraciones, abrasiones y muerte en caso de una caida libre a 80 pies de
altura
sobre el piso.
Empleados estuvieron trabajando diaria y continuamente en diferentes
tareas tales
como: mantenimiento, trabajos de electricidad, trabajos de mecanica y
caminaron
sobre un escalon de cemento de 6'6" de largo x 1'1" de ancho localizado en
la
entrada del area del elevador para personal, la cual a la misma vez no
tenia
barandas de seguridad o cualquier tipo de porton de cierre automatico en
el lado
del frente del elevador para personal que evite que los empleados puedan
tener
una caida al vacio de aproximadamente 80 pies de altura sobre el piso.
Localizacion:  En el lugar de trabajo conocido como Federacion de
Asociaciones
Pecuarias de PR, ultimo piso, en la entrada al area del elevador para
personal.
Entre otros metodos, un metodo factible y aceptable para corregir este
riesgo es
la eliminacion del escalon de cemento en esta area y de colocar barandas de
seguridad o un porton de cierre automatico en el frente del elevador para
personal
para evitar un riesgo de caida libre".
