Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that, employees were
exposed to a 24 foot fall hazard while working in a basket on a rough
terrain
forklift truck.
(a)Employees of HDC Construction, LLC were using the intermediate rails of
the
rough terrain forklift truck basket to gain height.  The employees were
working
at approximately 24 feet using a rough terrain forklift truck.  One of the
employees did not have his lanyard anchored in to the basket or truck.
(b)The operator which was the carpentry supervisor, was not in the
operating
position or near the rough terrain forklift truck, and the basket did not
have any
controls to operate the vehicle.
Among other methods, a feasible and acceptable means to correct this
hazard are to follow
ASME/ANSI B56.6 Safety for Rough Terrain Forklift Trucks, Section 5.15.1
and to have the
operator be present and available to elevating the boom and allow the
employees to reach the
area that they were working on, and ensure that employees maintain their
feet
on the floor of
the basket.
No certification required.  Violation Abated.on
