Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: (a)The employer did not ensure that the JLG Skytrak Rough Terrain Forklift being used to support a personnel platform complied with ANSI/ITSDF B56.6-2005, Safety Standard for Rough Terrain Forklift Trucks, Part II, Section 5.15 Elevating Personnel in that: the platform was constructed to an approximate 12 foot length that exceeded a width greater than the overall width of the truck; the width of the platform exceeded the maximum ten inches allowed beyond the load bearing tires; the personnel platform was not secured to the lifting carriage and forks; and the platform did not have a restraining means in place, such as railings, chains, cable, body harness(es) and lanyard(s), to prevent personnel from falling off of the personnel platform. One feasible means of abatement would be to ensure that the personnel platform meets the requirements of ANSI/ITSDF B56.6-2005 Safety Standard for Rough Terrain Forklift Trucks; Part II, Section 5.15 Elevating Personnel. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
