Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall hazards:
(a)At the PacSun jobsite;  an employee was exposed to multiple injuries
and/or death
when removing ducts and conduit from the ceiling using a JLG 1930ES scissor
lift and sitting on the top rail.
Among other methods, feasible and acceptable methods of correcting the
hazard:
Conduct all work standing on the floor of the platform.
Use the scissor lift in accordance with the acceptable requirements of the
American
National Safety Standards for Self propelled Work Platforms; ASME/ANSI
A92.6 1999,
Section 7.10.9: Personnel shall maintain a firm footing on the platform
floor
while
working thereon. Climbing by occupants on the midrail or toprail of the
aerial platform
is prohibited.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
