Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
(a)At the Charter Wire jobsite, an employee was conducting painting
operations
from the mid-rail of a Skyjack SJ111-3226 scissors lift and was exposed to
a fall
hazard of approximately 27 feet 11 inches.
A feasible means of abatement would be to comply with American National
Standards Institute (ANSI) A92.6-1999 Self-Propelled Elevating Work
Platforms
which requires workers to maintain firm footing on the platform floor while
working thereon and states that climbing by occupants on the mid-rail or
top-rail
of the aerial platform is prohibited.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.
