Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to amputation hazards when operating a riding lawn mower as a result of the following: (a)Employees operating the Jacobsen Green King IV riding lawn mower were exposed to amputation hazards when removing the grass clippings bin while the blades were actuated due to a defective interlock which turns the mower off when the operator leaves the seat. (b)Employees were not trained on the operation of the riding lawn mower according to the operator's manual. (c)The employer failed to ensure the safe operating conditions of the mower due to lack of daily inspections as specified in the operator's manual. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as: (a)Following the operator's manual. (b)Following ANSI/OPEI B71.1, Section III. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
