Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to wood dust explosion, deflagration or other fire hazards:
(a)The enclosure-less dust collectors in the production department were
located inside the
building, were used for dust collection with sanders and planers that had
mechanical
material feeds, and collected dust was not removed daily or more
frequently if necessary.
Among other methods, one feasible and acceptable abatement method to
correct these
hazards is to implement the protective measures set forth in the National
Fire Protection
Association Standard for the Prevention of Fires and Explosions in Wood
Processing and
Woodworking Facilities, NFPA 664 (2007 edition), specifically section
8.2.2.5.1.4 (7)
(a) through (g) which address enclosure-less dust collectors.
(b)Foreign material was not prevented from entering the floor sweep at the
enclosure-less
dust collector used at the CNC router.  Among other methods, one feasible
and
acceptable abatement method to correct this hazard is to install a screen
or magnetic
separator at the floor sweep as described at NFPA 664, A7.12.2.
(c)Flexible ducts used at the CDC router and the Buffering sander were
non-conductive
plastic.  Among other methods, one feasible and acceptable abatement
method to correct
this hazard is to install metallic ductwork as described at NFPA 664,
8.2.2.2.1.1.
(d)Compressed air was used to blow-down high areas.  Among other methods,
one feasible
and acceptable abatement method to correct this hazard is to follow the
requirements
listed at NFPA 664, 11.2.1.1 regarding minimizing the generation of dust
clouds.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
