Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: due to the possible overloading of hoist and/or loads being dropped due to the absence of rated loads for "Below The Hook Lifting Devices" not having been conspicuously displayed on the device(s) (a)Superior Boat Works - Wheelabrator area - On or about February 13, 2008 "Below The Hook Lifting Device" was being used that had not been rated or marked for such use. All such devices must have the rated load marked on the structure where it is visible and have a permanent markings displaying manufacturer's name, serial number, lifter weight if over 100 pounds and the rated load. Among other methods, one feasible and acceptable abatement method to correct this hazard is to; only use those devices which meet good engineering design, construction, and inspection. Consult and adhere to those requirements written in ANSI/ASME B30.20, "Below The Hook Lifting Devices".
