Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to the absence of markings on a "Below-the-Hook Lifting Device" that was also bent or damaged from lifting excessive loads. (a)On or about May 28, 2008, at the resin dipping tanks, the Below-the-Hook Lifting Device was not marked with the rated load and the inspection plate listing the results of the inspection and testing: 1. manufacturer's name and address 2. serial number of the device 3. lifter weight if over 100 lb (45) kg) 4. rated load Reference Section 20-1.2.1 - Markings; Section 20-1.3 - Inspection; Section 20-1.4 - Testing; and Section 20-1.5 - Maintenance
