Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to a damaged storage rack as to: (a)On or about May 29, 2008 in the shipping and receiving area, one of the front support legs of a storage rack was corroded, damaged, and partially collapsed. Among others, one feasible and useful abatement to correct the hazard is to: (1)Replace the damaged leg.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from a step ladder as to: (a)On or about May 29, 2008 in the maintenance shop a step ladder was used to access the mezzanine storage area by stepping on the top step and the top cap of the ladder. Among others, one feasible and useful abatement method to correct the hazard is to: (1)Install a fixed ladder designed to specifications as listed in 1910.27 - Fixed ladders.
