Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to caught-in hazards, in that, no emergency stopping device was provided for employees at the remotely located and automatically controlled stick buggy loading conveyor system station: (a)During the period June 10, 2008 through July 9, 2008 at the worksite the automatically controlled stick buggy conveyor system did not have an emergency stopping device installed for use by the employees tending to the stick buggies exposing the employees to caught-in hazard: Among other methods, one feasible and acceptable abatement method to correct this hazard is to install an emergency stopping device at the work station used by the employee that tends to the stick buggy loading as required by: ANSI/ASME B20.1 - 2000, Section 5.11.2 Control Station (c) Remotely and automatically controlled conveyors, and conveyors where the operator stations are not manned or are beyond voice or visual contact from drive areas, loading area, transfer points and other potentially hazardous locations on the conveyor path not guarded by location, position, or guards, shall be furnished with emergency stop buttons, pull cords, limit switches, or similar emergency stop devices.
