Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that an employee
was exposed to a crush hazard by riding on the side of a bulldozer that
was not equipped with
a passenger seat and seat belt.
(a)On or about September 12, 2008 an employee was observed riding on the
side of
a model D4G Caterpillar Bulldozer as the operator was pushing a large
dumpster. The
bulldozer was not equipped with a passenger seat and was not designed to
carry
passengers.
Caterpillar Operation & Maintenance Manual (SEBU7479-05) for D4G Track-Type
Tractor,Safety Section, Machine Operation, states "Do not allow riders on
the machine
unless the machine has the following equipment: additional seat, seat
belt, rollover
protective structure (ROPS)."
