Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that:_employees were exposed to crushing hazard. (a)Warehouse - On or about 1/14/2009 employees were operating a Toyota forklift, model # 5FGC15 and Toyota forklift, model # 426FGU25 which did not have seat belts. Among other methods, a feasible and acceptable method of correction is to install a seat belt retro-fit package and require seat belts to be worn when the forklift is in operation.
