Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being stuck by falling automotive lift. (a)Yard area - On or about April 23, 2009 mechanic employees were exposed to a stuck by hazard while working on vehicles that were lifted onto the lift. The locking device had been locked in an unlocked position. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Repair the lift device so that it can be placed in the locked position when employees are working on vehicles. Refer to ANSI/Automotive Lift Institute ALOIM - 2000 "Standard for Automotive Lifts" which states "If any of the conditions listed in 4.4.4 (4) through (10) are observed, then the lift shall not be used until the cause of the problem has been determined and the appropriate repairs have been made by qualified automotive lift service personnel"
