Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that, employees were exposed to a crush by hazard from not
wearing a seat belt:
(a)Highway 63 - On or about April 29, 2009 an employee was observed
operating
a Puckett Machinery paving compactor without wearing a seat belt.
Among other methods, one feasible and acceptable abatement method to
correct the
hazard included but not limited to:
1. Ensure employees fasten seat belt when operating paving compactor.

employees, in that, employees were exposed to a fall hazard from standing
on the platform of
moving Roadtec asphalt paver:
(a)Highway 63 - On or about April 29, 2009 an employee was observed
standing on
the platform of the Roadtec RP-190 asphalt paver.
Among other methods, one feasible and acceptable abatement method to
correct the
hazard included but not limited to:
1. Prohibit rider(s) other than the operator from riding on Roadtec RP-190
asphalt paver.
