Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employee(s) were exposed to being crushed while operating a John Deere 4250 tractor which did not have seat belts, but did have a rollover protective structure (ROPS) cab. (a)Coldwater Grain Elevator facility - On or about May 19, 2009, employees were exposed to being crushed while operating the John Deere 4250 tractor, which did not have seat belts installed according to the manufacturer's specifications. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide seatbelts, train the operators, and assure that operators comply with the manufacturer's recommendations for operator safety, i.e., to wear seatbelts whenever the tractor is equipped with ROPS or a cab.
