Title 40.1-51.1(a) Code of Virginia: The employer, D & F Construction, did
not furnish employment and a
place of employment which were free from recognized hazards that were
causing or likely to cause death or
serious bodily harm to employees in that:
On November 13, 2007, at 19th Road and Upton Street, Arlington, Virginia,
employees of D & F Construction
were using a 10' long job made ladder constructed of 2 x 4 lumber to enter
and exit a trench which was 6' 4''
deep.  The ladder had no filler blocks inserted between the cleats.
One feasible and acceptable abatement method, among others, to correct
this hazard is for the employer to
construct the ladder in accordance with American National Standards
Institute (ANSI) A14.4-1979, Safety
Requirements for Job-Made Ladders, section 4.5.2 which provides as
follows: "Filler blocks of the same
thickness as the cleats shall be inserted between the cleats and shall be
butted tightly against the underside of
each cleat."
