Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of oxygen deficiency and/or dangerous
accumulations of toxic vapors
or gases as well as delayed rescue while working in a confined space:
a) Location - 4 Rogers Brook East, Andover, MA:
On or about October 9, 2007, an employee was exposed to bodily injury
hazards while
operating a vibrating compactor in a crawl house under a house.
b) Location - 4 Rogers Brook East, Andover, MA:
On or about October 9, 2007, the employer did not ensure that testing of
the air in the
confined space (crawl space) was conducted before and during entry while
using a
gasoline owered vibrating plate compactor.  The employee was overcome by
carbon
monoxide.
Among other methods, feasible means of abatement would be to develop and
implement
a confined space entry program meeting the requirements of ANSI
Z117.1-1999 or newer
or OSHA 1910.146.  The program should include:
1.  Use of an effective retrieval method such as body harness, tether
line, and winch
system.
2.  Effective means to summon immediate rescue and other emergency
services as soon
as attendant determines need.
3.  Air testing/monitoring propr to entry and continously whenever there
is a potential
for oxygen deficiency or entry of toxic/hazardous gases or vapors.
4.  Effective training of the authorized entrants, attendants, and all
affected employees.
