Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that they were exposed
to struck-by hazards from a 966 D Caterpillar Wheel Loader, Serial Number
94X034 79.
(a) Location - 181 Sidney Street, Cambridge, MA:
On or about October 17, 2007, employees were exposed to struck-by hazards
while
working adjacent to a 966 D Capaterpillar Front Loader.
Among other feasible means of abatement methods for this hazard include,
but are not
limited to:
1. Establish and enforce an adequate procedures to ensure that all
personnel working near
moving equipment are accounted for and positioned a safe distance away
from the danger
area of the machine prior to allowing the Front Loader to move.
2. Develop a method that would effectively allow employees to remain in
constant
contact with one another when heavy equipment is scheduled to be used.
3. Appoint a safety monitor/signalman during the process of utilizing the
Front Loader
to ensure workers do not access the work area and all workers are
positioned a safe
distance from the machine to be moved.
4. Develop and implement signals  that are consistent and understood by
all personnel
and only one monitor/signalman is utilized at a time. In the event there
is a transfer from
one monitor/signalman to another, this action needs to be understood by
all workers
involved.
5. Enforce all provisions of the program.
