North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) at the construction site, the personnel lift basket/platform used in conjunction with the Lull rough terrain forktruck had not been provided with a rated load capacity prior to use. Reference: The American Society of Mechanical Engineers, Safety Standard For Rough Terrain Forklift Trucks, ASME B56.6-2002, Part II, Section 5.15, Elevating Personnel. Reference: The American Society of Mechanical Engineers, Safety Standard For Rough Terrain Forklift Trucks, ASME B56.6-2002, Part III, Section 8.5, Nameplates and Markings. Among other methods, one feasible and acceptable method to abate this hazard is to immediately provide a loading rating capacity test of the personal lift platform and affix the maximum capacity to the attachment.
