Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of slips and falls: a)Kitchen: An Employee stood with one foot on the Dean Gas Fryer and another on the appetizer refrigerator in order to reach the ventilation hoods and filters located overhead, on or about 1/31/07. One feasible and acceptable abatement method would be to use a ladder or a step stool to access this location. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
