Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a)Sierra Baler: An employee attempting to release the shear cylinder of the baler, walked on the beam on top of the baler approximately 13 feet above the ground without fall protection, on or about 4/8/08. Feasible and acceptable methods for abating this hazard are: 1)Train employees to only walk on areas of the machine that were intended for use as walking/working surfaces according to the manufacturer's design. 2)Train employees to use alternative means of accessing the shear cylinder such as a man lift or a ladder. 3)Conduct preventative maintenance on the shear cylinder to prevent the need of the operator to release it. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
