Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees 2) Provide an appropriate scissor lift. 3) Provide a work platform for the industrial truck following the protection outlined in the ASME Standard B56.1-2000 paragraph 4.17.3 which includes that the platform complies with the design requirements in paragraph 7.36.3. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
