Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being infected with Mycobacterium tuberculosis through contact with patients whom were or may be infected with tuberculosis: a)Transportation: EMTs and Nurses were exposed to the hazard of being infected with Tuberculosis through contact of active and suspected TB patients when transporting them to various medical and nursing home facilities. Employees were not provided the two-step baseline TB screening upon hiring. On or about 7/31/08 b)Transportation: EMTs and Nurses were not provided Tuberculin skin tests (TST) annually as per the CDC guidelines. On or about 7/31/08 Feasible and useful abatement methods for reducing this hazard as recommended by the Centers for Disease Control, among others, are: 1) Provide medical surveillance (at no cost to employees) including the required administration and interpretation of TSTs. The frequency of the tests must be in accordance with the current CDC guidelines. 2) Develop and institute a written TB infection control plan to ensure prompt detection, airborne precautions, and treatment of patients who have suspected or confirmed TB diseases. 3) Implement effective work practices for the management of patients with suspected or confirmed TB disease. 4) Train and educate employees regarding TB, with specific focus on prevention, transmission, and symptoms. 5) Use the appropriate respiratory protection control by implementing a respiratory protection program for employees and patients. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.CE
