Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck by and caught between hazards associated with operating powered industrial trucks while not utilizing the safety equipment provided. Throughout the facility at 4125 S 72nd Street, Omaha, NE 68127 - The employer has employees operating several powered industrial trucks listed as: Caterpillar Forklift, Model # GC30K, Serial # AT83Co1234, Toyota Forklift Model # 7E33U25, Serial # 90055 and Caterpillar Forklift Model # M40062, Serial # 18-85X25. The employees are using the PITS to move product throughout the facility and are operating without the use of seatbelts. Abatement certification and abatement documentation is required for this violation.
