Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crush by/struck by hazard:
a) 60 E Hanover Ave, Morris Plains, NJ
While tipping a container into Rear Loading McNeilus Waste Collection
truck #48, the container
shifted and crushed the left arm of the operator between the container and
the waste collection
truck.
Violation occurred on or about 10/03/07
Abatement Note:
Among other methods, one feasible and acceptable abatement method to
correct this hazard is:
1) Develop and implement a maintenance program that ensures that all
required safety features
are operational and functioning, and repairing, prior to placing equipment
into service, any
reported malfunction or defect that affects the safe operation of the
equipment, in accordance
with ANSI Z245.1-1999, Section 6.1.5 (c).
2) Ensure all container lifting hooks are equipped with a safety latch
according to ANSI Z245.1-
1999, Section 7.3.2.5.1(b).
