Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards due to the forklift not being attended when the boom was in the elevated position: (a) For the employees cutting block from the forklift work platform elevated approximately 20 feet above the ground, located at 4300 17th Avenue South, Fargo, North Dakota. Among other methods, one feasible means of abatement is to comply with the manufacturer's recommendations and to follow the requirements of ANSI B56.6 Safety Standards for Rough Terrain Forklift Trucks, Section 5.15.1(s) which states: "A trained operator shall be in position to control the rough terrain forklift truck, or available to operate controls if the platform is not equipped with controls." Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) For the employees exposed to fall hazards of approximately 20 feet while working from a platform suspended by a rough terrain forklift that exceeded the wheelbase of the forklift by more than 10 inches on either side, located at 4300 17th Avenue South, Fargo, North Dakota. Among other methods, one feasible means of abatement is to comply with the manufacturer's recommendations and to follow the requirements of ANSI B56.6 Safety Standards for Rough Terrain Forklift Trucks, Section 8.24.1(b) that states: "..floor dimensions which shall not exceed two times the load center..., nor have a width greater than the overall width of the truck measured across the load bearing tires plus 10 inches on either side."
