Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing and/or struck-by hazard: (a) On or about 11/08/07, and at times prior to that date, employees operating, and being lifted on a personnel platform, on the Lull 644-D rough terrain forklift, serial #99AL25W24-696, were exposed to the hazard of forklift rollover created by the rough terrain forklift being operated beyond the load handling capabilities and limitations of the all terrain forklift. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the operator's manual for the Lull 644-D telescoping rough terrain forklift, serial #99Al25W24-696, and the requirements of ANSI B56.6-2005 Safety Standard for Rough Terrain Forklifts for operating this all terrain forklift. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and/or struck-by hazards: (a) On or about 11/08/07, and at times prior to that date, employees operating the Lull 644-D rough terrain forklift, serial #99AL25W24-696, and not wearing the seat belt located in the operator's cab were exposed to the potential for injury created by forklift rollover. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the requirement of ANSI B56.6-2005 Safety Standard for Rough Terrain Forklifts paragraph 6.2.1 (a) which states: "Before starting to operate the rough terrain forklift truck the operator will be in operating position and fasten seat belt, if so equipped."
