Vermont Statute, Title 21 LABOR: CHAPTER 3, SAFETY: Subchapter 5.
Occupational Safety and Health Section 223, Duties and Section
5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or
likely to cause death or serious physical harm to employees, in
that, employees were exposed to the hazards of infrared non-
ionizing radiation capable of causing severe burns of the eyes
and skin. Specifically class 1V product etching (50 watts, carbon
dioxide, wavelength 10.6 nanometers). Facility is using class IV
laser coder for etching product packaging. Employees were not
using eye protection, no signage, no restricted control area. The
company did not provide a laser safety program or have a laser
safety officer at the time of the inspection. Some feasible and
acceptable abatement methods to correct the hazard are: 1) Assign
a Laser Safety Officer and give proper training. 2) Conform to
the requirements of the American National Standards Institute
Publication, ANZI Z136.1-2000.
