of the Occupational Safety and Health
Act of 1970:  The employer did not furnish employment and a place of
employment which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to the hazards of the damaged and defective motor
vehicle equipment and exposed to the
hazards as a result of missing equipment while operating the company fleet
of vehicles consisting of but not limited
to large size and mid-sized pick up trucks.

Violation: The employer did not furnish employment and a place of
employment which were free from recognized
hazards that were causing or likely to cause death or serious physical

exposed to the hazards of the damaged and defective equipment such as but
not limited to cracked and broken
windshields, inoperative braking stop lights, inoperative vehicle
directional signals, tires with little to no treads,
absence of State Vehicle Inspection Certification, Expired State Vehicle
Inspection Certification, Failed State
Vehicle Inspection Certification, front headlight not secure to vehicle
body, vehicle doors that do not close
adequately, vehicle brakes not working, broken rear tail lights, back-up
reverse lights inoperative, and exposed
to the hazards as a result of missing equipment, such as windshield
wipers, while operating the company fleet of
vehicles consisting of but not limited to large size and mid-sized pick up
trucks

29 CFR 1910.268 (J)(1)(ii): The employer shall ensure that tests shall be
made at the beginning of each shift by
a competent person to ensure the vehicle brakes and operating systems are
in proper working conditions

to ensure the vehicle brakes and operating systems are in proper working
condition by requiring employees to
operate the fleet of vehicles with damaged and defective equipment such as
but not limited to cracked and broken
windshields, inoperative brake lights, inoperative vehicle directional
signals, tires with little to no treads, absence
of State Vehicle Inspection Certification, Expired State Vehicle
Inspection Certification, Failed State Vehicle
Inspection Certification, front headlight not secure to vehicle body,
vehicle doors that do not close adequately,
vehicle brakes not working, broken rear tail lights, back-up reverse
lights inoperative, and exposed to the hazards
as a result of missing equipment, such as windshield wipers, while
operating the company fleet of vehicles

This violation is classified as Willful because the employer demonstrated
plain indifference to the VOSHA
regulations who was aware of the continuing compliance problem and made
little or no effort to correct the
hazards  to avoid  the continued employee exposure to the unsafe
conditions of the vehicles.s
