21 VSA Title 23, Chapter 3, Sub-chapter 5, Section 223(a), Section 5(a)(1)
of the Occupational Safety &
Health Act of 1970:  The employer did not furnish employment and a place
of employment which was free
from recognized hazards that were likely to cause death or serious
physical harm to employees in that
employees were driving fork trucks without using seatbelts which exposed
them to crushing hazards associated
with fork truck tip-overs.
Location:  Village Cannery of Vermont, Production and Warehouse areas
Violation:  The employer did not provide a place of employment free from
the recognized hazard of not using
the seatbelts while driving fork trucks which is likely to cause serious
physical harm to employees, in that,
employees are thereby exposed to crushing injuries related to fork truck
tip and roll overs.
Feasible and acceptable means of abatement include but are not limited to:
a) Retraining fork truck drivers on the seat belt requirement.
b)Having seat belt use an entry on the checklist in use prior to operation.
c)Enforce use of seat belts with a system of warnings leading to
write-ups, etc (disciplinary action).inary
