Vermont Statute, Title 21 Labor : Chapter 3. Safety : Occupational Safety and Health : 223. Duties: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed crushing hazards associated to fork lift tip-overs. Location: Amoskeag Woodworking, Inc., Colchester Vermont located at 868 Prim Road Colchester Vermont. Violation: Both the Vermont Statute, Title 21 Labor : Chapter 3. Safety : Occupational Safety and Health : 223. Duties: and the Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from a forklift overturning or from the operator falling off the forklift, due to the fact that an operator restraint system (seat belts) was not provided by this employer on the powered industrial truck. Among other methods, one feasible and acceptable method to correct this hazard is for the employer 1) to install an operator restraint system on the powered industrial truck and; 2) to effectively enforce the use of the operator restraint system retrofitted on the respective powered industrial truck.
