North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall from elevation hazard: a)roof of building, for the JLG-Lull Scissor Lift, employees were climbing out of the lift platform by stepping on the railing and out onto the building's purlins, exposing themselves to a 34-foot fall hazard. Among other methods, one feasible and acceptable method of abatement is to follow the recommendations of Chapter 8.10 (9) of ANSI/SIA A.92-1999 which states "Personnel shall maintain firm footing on the platform while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited".
