North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to struck by overturning and/or
falling objects hazards:
a)jobsite, North side of building, for the National Crane mobile crane
being used to lift a Miller
Trailblazer welder/generator to the roof of a building under construction.
On 10/18/07, the
front outrigger on the side of the crane nearest the building and the two
rear outriggers were
not lowered in place causing the mobile crane to overturn and the crane
boom to crash into the
building's masonry wall throwing the welder/generator onto the metal roof
decking, damaging
the roof.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
was to have all outriggers lowered, set, and the crane balanced prior to
hoisting a load.
