5(a)(1): Section 5 (a)(1) of the Occupational Safety and Health Act of
1970:  The employer did not furnish
employment and a place of employment which were free from recognized
hazards that were causing or likely
to cause death or serious physical harm, including severe burns, to
employees in that employees were exposed
to dust explosion, deflagration or other fire hazards from dust collectors
that lacked explosion protection
systems:
a)The dust collector in the Mixing Department did not have an explosion
protection system, and was
installed inside the building;
b)The dust collector in the Extruder Department did not have an explosion
protection system, and was
installed inside the building;
c)The dust collector installed outside the rear of the building which
exhausts the cyclone at the grinder
was not provided with an isolation device to prevent dust explosions from
traveling back into the
building.
Among other methods, a feasible abatement method to correct this hazard is:
(1) Relocate indoor dust collectors to outside the facility or install
engineering controls such as suppression,
inerting, and/or explosion venting to the outside; and (2) Install
isolation devices to prevent explosions back
through ductwork.  Install per requirements of the National Fire
Protection Association's (NFPA) Standard
654, "Standard for the prevention of Fire and Dust Explosions from the
Manufacturing, Processing and
Handling of Combustible Solids" and NFPA 69, "Standard on Explosion
Prevention Systems" and NFPA 68,
"Guide for Venting Deflagrations".
