Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to dust explosion, deflagration, and other fire hazards from dust collectors being located inside a building: (a) For the employee cutting with a portable electric grinder on a duct entering a Buhler bag house style dust collector, with combustible dust present, in the production area, located at 605 22nd Avenue East, Williston, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to follow the NFPA 61, National Fire Protection Association - Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Products Facilities, Section 8-4.2, which includes, among other requirements, to locate the dust collector outside of the building and provide suitable explosion protection. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter").tion

Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be the implementation of a written hot work permit system as described in Section 11-2 of the NFPA 61, National Fire Protection Association - Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Products Facilities, or NFPA 51B, Standard for Fire Prevention During Welding, Cutting, and Other Hot Work.
