Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and engulfment hazards: (a) On or about January 3, 2008, for the employees working on or below the roof eave at Reile's Transfer & Delivery at 4007 33rd Street NW, Fargo, North Dakota, and were exposed to snow drifts shifting and sliding from the roof. Among other methods, a feasible means of abatement is to not allow employees to be in the danger area below the roof where snow engulfment hazards may exist.
