T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that, employees were exposed to potentially toxic and explosive atmospheres. An example was on January 30, 2008 when process material of an Alcogum SL-73 reaction was released from reactor vessel T-49 by means of a removed and improperly replaced reactor manway cover resulting in employee exposure to unknown concentrations of ethyl acrylate vapors. As feasible abatement of this hazard, the employer could: a.Consider the effect on employee safety and health of opening process equipment prior to reaction process completion, under both normal and abnormal conditions, and develop and enforce procedures or work rules detailing procedural steps, use of engineering controls, use of personal protective equipment, established restricted activities, and other appropriate safeguards for opening process equipment; b.Consider the effect on employee safety and health of improper replacement/closing of process equipment, under both normal and abnormal conditions, and develop and enforce procedures or work rules detailing procedural steps, use of engineering controls, use of personal protective equipment, established restricted activities, and other appropriate safeguards for closing process equipment; and c.Implement established procedures to safely manage the hazards of the Alcogum SL-73 reaction process. For example, ensure the implementation of procedures detailed in the "Consequence of Deviation Procedure" (OPWI199) for L-Series processes and the "Alcogum SL-73 Formula and Procedure".
