T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the employer did not ensure that the pallet racks in the facility were free from hazards such as: a) A section of rack near the doorway of the small material packaging room had damage to one of the upright columns and two bent and buckled cross braces. b) The racks throughout the facility were not bolted to the floor at every upright column. Amoung other methods, one feasible and acceptable abatement method to correct this hazard is to repair the damaged portion of the rack in accordance with the ANSI MH 16.2 sec 3.11 & sec 4.2 , additionally anchoring the racks throughout the facility in accordance with ANSI MH 16.2 sec 1.4.
