Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed a tripping and falling hazard.
The guardrail on the left side of the vehicle mounted lift device was
broken.The guard rail which
is designed to be secured in the upright position could not be secured in
the upright position and
was laying flat on the walking/working surface of the platform creating a
tripping and falling
hazard exposing employees to a fall of eighteen feet to the tarmac below
while servicing an
aircraft.
Among other feasible and acceptable methods of abating this violation
including but not limited
to the following requirements of ANSI/SIA A92.7-1990-American National
Standard for Airline
Ground Support Vehicle-Mounted Vertical Lift Devices:
a) Inspect and maintain each unit in a safe operating condition.
b) Any unit not in safe operating condition shall be removed from service
until it is repaired.
c) Instruct the operators to inspect the units before use and report any
unsafe conditions
and insure that unsafe items are corrected before further use of the unit.
d) Insuring that movable guardrails and doors are in place or closed unless
their location requires that they be open or moved for normal operation of
the unit.
Violation occurred on or about 12/04/07 at terminal C, gate 135 at Newark
Liberty International
Airport.
