North Carolina General Statute 95-0129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall or struck-by hazards: a)Walnut Grove subdivision, rear exterior of condominium #2, employer allowed employees to work from an attachment on a skid steer at elevations 10' and above. Among other methods, one feasible and acceptable abatement method to correct these hazards is for the employer to prohibit employees from riding the skid steer.
