Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from the forklift: (a)901 Highway 3 West: On or about April 11, 2008, and at times prior thereto, the employer did not instruct and/or enforce the utilization of the seat belts by operator(s) of the forklift(s). (b)901 Highway 3 West: On or about April 11, 2008, and at times prior thereto, the controlling employer did not ensure that its sub-contractor Dan's Welding & Fabrication LLC instructed and/or enforced the utilization of the seat belts by operator(s) of the forklift(s). Note(1): Amongst other methods, several feasible and acceptable methods to correct this hazard are by complying with the manufacturer's operation guide regarding use of the manufacturer supplied seatbelt and/or QNWI/ITSDF B56.1-2005 (Reaffirmation of ASME B56.1-2004), Section 7.41, Operator Restraint Systems. Note(2): Abatement certification and documentation ARE required for this item.
