Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing injuries while operating powered industrial trucks: a)In the workplace: On June 17, 2008, and at times prior thereto, employees did not wear a seat belt while operating the Caterpillar fork lift. b)In the workplace: On June 17, 2008, and at times prior thereto, the Hyster #30 fork lift did not have a seatbelt installed. Note 1) Amongst other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of seatbelts when operating powered industrial trucks (forklifts) throughout the establishment as required by ANSI/ASME B56.1. Note 2) Abatement certification is required for this item.
