Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being thrown from and/or being crushed by a rough terrain forklift. a)Southeast corner of the building: On or about June 19, 2008 and at times prior thereto, an employee was operating a GEHL Dyanalift rough terrain forklift without using the equipped seatbelt. Abatement Note: Among other methods, one feasible and acceptable abatement method would be to require and enforce the use of seatbelts while operating rough terrain forklifts per ANSI B56.6-2002. Note: Abatement certification is required for this item.
